Terms of Service

These terms are the agreement between you and FitZen. By downloading the app or using this website you accept them. If you do not accept them, please do not use the service.

What FitZen is

FitZen is a nutrition tracking app. It estimates calories and macronutrients from photographs of meals, keeps a food diary, tracks water, steps and fasting windows, generates recipes, and answers nutrition questions through an in-app assistant. This website is its marketing site and a recipe archive.

What FitZen is not

FitZen is not a medical service. It does not diagnose, treat, cure or prevent any condition, it is not a medical device, and nothing in the app or on this site is medical advice.

The nutrition figures the app produces are estimates. Photo analysis infers foods and portions from an image, and it can be wrong — particularly with food covered in sauce, stacked, or in closed containers. Treat every number as an approximation and correct it when you know better.

Consult a doctor or a registered dietitian before making significant changes to your diet, and especially if you are pregnant or breastfeeding, under 18, managing a medical condition such as diabetes, kidney or heart disease, taking medication affected by diet, or have any history of disordered eating. If you are in medical distress, contact your local emergency service, not this app.

You are responsible for what you eat and for the decisions you make with the information the app gives you.

Your account

You need an account to use most features. You must:

  • be at least 16 years old,
  • give accurate information when you sign up,
  • keep your login credentials to yourself,
  • tell us at info@alimertgulec.com if you believe someone else is using your account.

You are responsible for activity that happens under your account.

Subscriptions, free trial and payment

The app is free to download, and core tracking features are free to use. Unlimited photo analysis, the smart kitchen recipe generator and the nutrition assistant require a Premium subscription.

  • Free trial — new subscribers get a 3-day free trial. If you cancel before the trial ends, you are not charged. If you do not cancel, the subscription starts automatically at the price shown when you subscribed.
  • Plans and prices — weekly, monthly and yearly plans are available. The exact price is the one shown in the App Store or Google Play in your local currency at the moment you subscribe. Prices differ between countries and can change; a change never applies to a period you have already paid for.
  • Billing — payment is charged to your Apple or Google account. We never see or store your card details.
  • Renewal — subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends.
  • Cancelling — cancel in your App Store or Google Play subscription settings. You keep Premium access until the end of the period you have paid for.
  • Refunds — refunds are handled by Apple and Google under their own policies. We cannot issue a refund for a purchase made through their stores, but if something has gone wrong, write to us and we will help you take it up with them.
  • Dietitian sessions, where offered, are sold separately from the subscription and are subject to the terms shown at the point of purchase.

Acceptable use

Do not:

  • use the service for anything illegal, or in a way that breaks a law that applies to you,
  • attempt to break, overload, reverse engineer or gain unauthorised access to the service,
  • scrape, copy or redistribute the content of this site or the app at scale,
  • upload content that infringes someone else's rights, or that is unlawful or harmful,
  • resell access to the service or share a paid account with people outside your household,
  • present the app's output as professional medical or dietary advice to others.

We may suspend or close an account that breaks these rules.

Your content

The photos, meals and messages you put into FitZen remain yours. You grant us the limited licence we need to operate the service: to store your content, to send meal photos to our AI provider for analysis, and to display it back to you. We do not use your content to advertise to you, and we do not publish it.

Our content

The app, this website, its design, text, recipes and code are owned by FitZen and protected by copyright. You may use the recipes for your own cooking and share links to them. You may not republish the archive, in whole or in substantial part, without written permission.

Recipes come with nutrition values that are calculated estimates for a standard preparation. Your own result will vary with ingredients, brands and portioning.

Availability and changes

We try to keep the service running, but we do not promise it will always be available or error-free. We may add, change or remove features. If we remove something significant that your paid subscription depends on, you can cancel and we will help you seek a pro-rata refund from the store.

Third-party services

FitZen depends on services we do not control, including Apple, Google, Firebase, RevenueCat and our AI provider. Their terms and privacy policies apply to your use of the parts of the service they provide.

Liability

To the extent the law allows, FitZen is provided "as is" and we exclude implied warranties. We are not liable for indirect or consequential loss, for loss of data caused by circumstances outside our reasonable control, or for decisions you make based on the app's estimates. Our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim.

Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all the statutory rights your local law gives you.

Ending the agreement

You can stop using FitZen at any time and delete your account from inside the app or from https://www.fitzenweb.com/account-deletion. Deleting your account does not automatically cancel a subscription bought through Apple or Google — cancel that in the store as well.

We may end this agreement if you seriously or repeatedly break these terms, or if we stop offering the service. If we stop offering the service, we will give reasonable notice and refund the unused part of a paid period where the law requires it.

Changes to these terms

We may update these terms. The effective date above always shows the current version, and for significant changes we will tell you in the app before they take effect. Continuing to use the service after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the Republic of Türkiye, and the courts of Türkiye have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer law of your country of residence.
